Zoning Board postpones variance decision, seeks counsel on procedural issues

NH NEWTON — Newton Zoning Board postpones subdivision variance decision after criterion vote fails. The board heard a variance request from Land Bank Properties LLC, represented by attorney Brett W. Allard, to subdivide property at 11 Merrimac Road with reduced frontage and lot-width requirements.

Public commenters raised concerns about wetland impacts and rural character. After closing the public hearing and entering deliberation, the board voted 0-4-1 on the first approval criterion (whether the variance would be contrary to public interest), with Attorney Allard requesting a continuance. The board voted 3-1-1 to rescind the public hearing closure and 3-1-1 to continue the hearing to April 1, 2026, while unanimously voting to consult legal counsel on procedural questions that arose during deliberation.
